Following the recent Supreme Court decision allowing firearms on private property open to the public by default, Hawaii businesses must post signs informing the public that guns are banned on their property.
Honolulu, HI, July 16, 2026 — In response to the U.S. Supreme Court's decision in Wolford v. Lopez, Brady Hawaii, in partnership with the Honolulu-based law office of Davis Levin Livingston, is producing and distributing free signs for Hawaii business owners who wish to communicate that firearms are not permitted on their property.
The Wolford v. Lopez decision, issued June 25 and effective immediately, allows firearms to be carried onto Hawaii private property open to the public unless a property owner affirmatively prohibits them. The law applies to such spaces as restaurants, hotels, shops, malls, and concert venues.
“Hawaii property owners now have to navigate the burden of affirmatively prohibiting firearms,” said Mark S. Davis, founding partner of Davis Levin Livingston. “Government can no longer prohibit firearms in local businesses. It is now up to all of us to exercise our right to maintain gun-free premises. We're proud to help Hawaii businesses exercise their property rights and preserve the safe, welcoming spaces they want for their employees and customers.”
“It is no coincidence that Hawaii has long had some of the nation’s strongest gun safety laws and lowest rates of gun violence,” said Erin Davis, Senior Counsel and Director of Litigation at Brady, who was born and raised in Hawaii. “The Wolford decision changed the private property default, but it didn't change what the people of Hawaii want, only Aloha. Most residents believe businesses should be able to remain gun-free, and putting up a sign makes that happen and keeps our community safe.”
By properly posting the signs, which follow legal specifications, business owners can legally prohibit a person from carrying firearms onto their property. Signs must be clearly legible from any point of entry onto the premises.
