In Garland v. VanDerStok, the Supreme Court takes up a reckless decision from the Fifth Circuit Court of Appeals striking down portions of the Biden-Harris Administration’s 2022 life-saving ghost gun rule. The Fifth Circuit’s most recent decision in the case, issued November 9, 2023, came after the Supreme Court twice reversed prior Fifth Circuit decisions against the rule. Crucially, thanks to the Supreme Court’s stay of the Fifth Circuit’s decision, the rule remains in effect while the Supreme Court hears the case.
This summer, Everytown for Gun Safety Support Fund, Brady Center to Prevent Gun Violence, and March For Our Lives filed an amicus brief before the United States Supreme Court in Garland v. VanDerStok. The amicus brief can be found here. GIFFORDS Gun Owners For Safety submitted an amicus brief that can be found here, and the Institute for Constitutional Advocacy and Protection at Georgetown Law Center submitted an amicus brief that can be found here, all urging that this rule be upheld.
