City of Gary v. Smith & Wesson

CASE STATUS: ACTIVE

AUGUST 30, 1999
INDIANA

Brady Represents City of Gary, Indiana, in Landmark Suit Against Major Gun Manufacturers

BACKGROUND

Over 25 years ago, Brady Legal brought a landmark lawsuit on behalf of the City of Gary, Indiana, against major gun manufacturers such as Smith & Wesson, Beretta USA Corp, Glock, and Hi Point, as well as major sellers of crime guns in and around the city. The lawsuit aims to hold the gun industry, manufacturers, and dealers accountable for their negligent conduct that contributes to the criminal gun market. Despite the gun industry's many efforts to evade legal repercussions for their role in fueling the criminal gun market, Indiana’s highest courts have said the case has merit and should proceed to trial. But yet again – for a fifth time – the gun industry has tried to legislatively end the case, getting yet another law passed by the Indiana legislature designed to kill the lawsuit. The trial court, however, ruled to allow the case to continue despite the new legislation. The gun industry defendants have appealed the ruling to the Indiana Court of Appeals. Brady is continuing to litigate these issues and fight to bring justice to the City of Gary.
