Washington, D.C., November 12, 2019 – Today, Brady applauds the Supreme Court of the United States for denying an appeal by Remington Arms Co. and allowing a suit filed by the families of those impacted by the 2012 Sandy Hook Elementary School shooting to move forward. The decision, Remington Arms Co. v. Soto, upholds the right of these victims to hold Remington accountable, despite an often-misread federal statute, the 2005 Protection of Lawful Commerce in Arms Act (PLCAA), which treats gun manufacturers differently than any other industry. Today’s ruling helps prove that PLCAA is not a blanket immunity from accountability for gun manufacturers. Remington argued that the case is ‘nationally important.’ We agree; it is nationally important that we hold Remington accountable for marketing weapons of war to the general public. It is nationally important that we revisit the gun industry’s special protection law, the 2005 Protection of Lawful Commerce in Arms Act (PLCAA), which should not prohibit grieving families to seek justice. And, it is nationally important that we finally secure justice for the families of those affected by the tragedy at Sandy Hook. PLCAA has for too long denied the victims and families of gun violence this justice, allowing the gun industry to act with impunity and delaying any accountability for their role in the gun violence epidemic in the United States.”Following the Supreme Court’s decision, families of those affected by the Sandy Hook Elementary shooting will be able to move forward with their suits against Remington, helping the families and victims of gun violence get their rightful day in court.Brady Legal has worked for over 30 years to set precedent, support victims, and hold the gun companies accountable for their role in gun crimes.
