Washington, D.C., October 22, 2021 - Today, Brady celebrates the introduction of the Firearms Retailer Code of Conduct Act by Rep. Jason Crow (CO-06). This bill is a common-sense solution to prevent dangerous transactions, such as straw purchasing and gun trafficking, that drive gun violence in communities, particularly urban and Black and Brown communities, across the country. Particularly in a year in which we have seen elevated shootings and crime, this bill will help to keep all Americans safe by keeping firearms out of the hands of those seeking to do harm and stopping the flow of dangerous firearms into our communities.

“As news reports and research have indicated, shootings and homicides spiked precipitously across the country during the coronavirus pandemic. We need solutions that address this crisis and the everyday gun violence that plagues communities all across the country. Rep. Crow’s Firearms Retailer Code of Conduct Act does just that, addressing the supply of firearms and targeting how these weapons are trafficked and supplied to those seeking to do harm. This supply-side approach works with dealers, who are the front line and often best defense to prevent gun violence, to stop straw purchases and other illegal sales that divert firearms to the illegal market. This bill will help to stop gun violence, particularly in urban and Black and Brown communities, which are disproportionately affected by this public health crisis. Brady thanks Rep. Crow for championing this common-sense public safety solution and urges the House of Representatives to pass it without delay."

About the Firearms Retailer Code of Conduct Act:

The Firearms Retailer Code of Conduct Act establishes business practices and certification requirements for gun dealers and their employees that are intended to curb the diversion of firearms into the illegal market.

  • Creates a training program for gun dealers and their employees, which will recertify every two years, to identify fraudulent or potentially unlawful firearms purchases

  • Requires employees of gun dealers to undergo background checks to ensure that they are able to legally sell firearms

  • Instructs gun dealers and their employees to refuse the sale of firearms to straw purchasers, gun traffickers, intoxicated persons, or those at risk of harming themselves or others

  • Requires dealers to secure firearms after close of business to prevent theft

  • Mandates the posting of notices indicating the signs of fraudulent or potentially unlawful firearms purchases and requires the display of contact information to report suspected illegal transactions

  • Requires that federally licensed firearms dealers maintain liability insurance as long as they are in the business of selling firearms

Making these provisions law, provides needed incentives to gun dealers — many of whom operate outside of the communities most impacted by everyday gun violence, frequently in less diverse and more affluent suburbs — to reduce gun trafficking.
