After Orchestrating the Passage of a Law Shielding the Gun Industry From the Most Consequential Legal Case in the Nation, the Defendants Have Moved to Dismiss the Case.

Washington, D.C., March 18, 2024 – Immediately after Indiana Gov. Eric Holcomb signed House Bill 1235 into law, the gun industry defendants filed a motion to kill off City of Gary v. Smith & Wesson et al., an active case seeking to hold major gun companies accountable for their role in fueling gun violence. The defendants, largely made up of board members of the National Shooting Sports Foundation (NSSF), cite the law they recently lobbied to pass as the grounds to dismiss the case. Since 1999, Brady, the nation’s oldest gun violence prevention group, has represented the City of Gary in the lawsuit and fought off decades worth of gun lobby attempts to destroy the case. HB 1235’s passage and enactment is one of the most egregious of the stalling efforts as it represents gross government overreach and threatens the sanctity of Indiana’s Constitution.

“We’re certainly not surprised to see how quickly the gun industry moved on dismissing the case, but it shows just how scared they are of discovery and the City’s proof at trial.
If the gun industry thought they could win this case, they wouldn’t be fighting so hard – and so dirty – to push through multiple laws intended to have it thrown out. They’re doing this because they know what the City’s case will reveal. Well, we are not afraid, and we will continue to exhaust every opportunity to keep the City of Gary’s case alive on behalf of its people and on behalf of all Americans who deserve to know what the gun industry is hiding.”
